Since 2017 GRC has been engaged in seeking accountability for Rohingya victims from Myanmar – including before the International Criminal Court (ICC) – for the persecution, international crimes and deprivation of fundamental rights suffered by them (such as killings, sexual and gender-based violence, torture, mutilations, destruction of property, and the arbitrary deprivation of liberty), particularly in the context of the August 2017 ‘clearance operations’ carried out by the Myanmar military, the Tatmadaw. These violent ‘clearance operations’, caused more than 700,000 Rohingya to flee to Bangladesh and who have since been living in extremely impoverished and dangerous conditions in makeshift refugee camps in Cox’s Bazar.
GRC represented the interests of 400 Rohingya women and girls, victims of the Tatmadaw’s crimes, organised under the name ‘Shanti Mohila’ (Peace Women) based in the Cox’s Bazar refugee camp.
The Request
GRC filed submissions to the ICC on behalf of Shanti Mohila in May 2018, asking the Court to investigate and prosecute crimes of genocide, apartheid, deportation and persecution perpetrated against the Rohingya since August 2017. On 6 September 2018, Pre-Trial Chamber I of the ICC granted the request of the Prosecutor seeking jurisdiction in relation to the deportation of the Rohingya from Myanmar to Bangladesh. The Chamber accepted arguments put forward by GRC on the possibility of the Court’s jurisdiction extending to other crimes committed against the Rohingya, such as persecution.
GRC also works with the Liberation War Museum (LWM) in Bangladesh, who aim to prevent the recurrence of genocide through the documentation and archival of historical records and engage closely with the Rohingya refugees in Cox’s Bazar. As part of our collaboration with LWM, GRC provided them training regarding documenting and investigating international crimes and LWM were part of our test cases for the Pilot Project phase of the Basic Investigative Standards for International Crimes (‘BIS’) App, to test the utility of the App in challenging environments, including Cox’s Bazar.
